The identification of problems with both medical and legal ramifications initially results from medical evaluations. Overlapping of medical and legal questions can occur in two different sets of circumstances. First is when the physician is the subject of the evaluation, that is, when the physician has made an error of diagnosis or treatment and is called to account in a civil or criminal court. Second, the overlap can occur when the physician is simply making an evaluation.
